Conditions of reproduction:
- Permission to reproduce from the photographic material supplied is dependent upon the full acceptance of the conditions listed below and will be cancelled automatically if any conditions are infringed.
- a. Where the application seeks to reproduce works under copyright, the Gallery will notify the Applicant of the copyright contact’s contact details, if known. It is the Applicant’s responsibility to obtain written permission from the copyright holder and provide a copy of permission to the Gallery.
b. The Applicant is responsible for any fees the copyright holder may impose, separate and distinct from any fees charged by the Gallery.
c. The Applicant shall indemnify the Gallery against any action whatsoever taken by the copyright owner(s) against the Gallery arising in any way whatsoever from the publication of the photographic materials by or on behalf of the Applicant. - The image/s must be reproduced without cropping, bleeding, alteration or overprint of any kind. If any alterations are required to the image, a colour proof must be provided for approval prior to publication. The Gallery reserves the right to reject those which are not of an acceptable standard.
- Image and copyright captions must be used without any alteration or abbreviation whatsoever and appear in association with the image. It is the publisher’s responsibility to acknowledge the artist and their work correctly in accordance with the Australian Copyright Act’s Moral Rights. If a detail of the image is used, the word ‘detail’ must appear in brackets after the title of the artwork.
- All reproductions must be credited as follows: “Collection of the Art Gallery of Ballarat”. Any additional credit line advised by the Gallery must also be included.
- If it is proposed to use the photographic material in relation to production of a dust jacket or cover, then separate prior approval must be obtained from the Gallery in writing. Only applications accompanied by proofs will be considered.
- Where possible, images will be sent to Applicants via Hightail, a website which allows the transfer of large files. In the case that this is not suitable, images will be sent on CD which is loaned to the Applicant for a period of six month and must be returned in good condition.
- The Applicant shall pay any Gallery charges in relation to this transaction on receipt of the photographic material.
- The Applicant shall supply the Gallery 1 complimentary copy of the publication.
- Permission to reproduce the photographic materials is granted for one time use only for the publication specified. A new application in writing must be lodged for any other publication including reprints, revisions and translations of the publication.
- The hire of images, purchase of prints or supply of digital scans from the Gallery does not give the rights to store or reproduce them or make them available to the public in any medium or form except for the reproduction or communication rights stipulated on the Licence to Reproduce. Nor does the supply of photographic material imply the availability of these rights.
